Critical analyses of the audit profession have become more common in recent years. Many of these analyses focus on the entire audit profession in developing their criticisms and concerns. In this paper, the scope of analysis is narrowed to examine in depth the auditing profession's use of the concepts of reasonable assurance and materiality in audit performance and audit communications. Reasonable assurance and materiality are the terms that auditors use to describe the scope of their responsibility to the public. Similarly, (...) reasonable assurance and materiality are the key determinants of audit effort. An overview of official guidance, practitioner reports, and academic research reveals that these two key concepts are not well specified nor are they consistently applied in audit practice. These findings are evaluated from two competing perspectives on professions – the traditional, functionalist perspective and the critical theorists' perspective. Evaluation from the latter perspective leads to a conclusion that the profession's use of these key terms to guide practice and communication leaves the profession open to charges of mystification and unjustified paternalism. Inspired by the success of generative linguistics and transformational grammar, proponents of the linguistic analogy (LA) in moral psychology hypothesize that careful attention to folk-moral judgments is likely to reveal a small set of implicit rules and structures responsible for the ubiquitous and apparently unbounded capacity for making moral judgments. As a theoretical hypothesis, LA thus requires a rich description of the computational structures that underlie mature moral judgments, an account of the acquisition and development of these structures, and an (...) analysis of those components of the moral system that are uniquely human and uniquely moral. In this paper we present the theoretical motivations for adopting LA in the study of moral cognition: (a) the distinction between competence and performance, (b) poverty of stimulus considerations, and (c) adopting the computational level as the proper level of analysis for the empirical study of moral judgment. With these motivations in hand, we review recent empirical findings that have been inspired by LA and which provide evidence for at least two predictions of LA: (a) the computational processes responsible for folk-moral judgment operate over structured representations of actions and events, as well as coding for features of agency and outcomes; and (b) folk-moral judgments are the output of a dedicated moral faculty and are largely immune to the effects of context. In addition, we highlight the complexity of the interfaces between the moral faculty and other cognitive systems external to it (e.g., number systems). We conclude by reviewing the potential utility of the theoretical and empirical tools of LA for future research in moral psychology. (shrink)

OBJECTIVES: To study the accuracy of reviewing ward notes (chart review) as a measure of the quality of care rendered to patients with "Do Not Resuscitate" (DNR) orders. DESIGN: We reviewed the charts of 19 consecutive, competent inpatients with DNR orders for evidence that the staff addressed a broad range of patient care needs called Concurrent Care Concerns (CCCs), such as withholding treatments other than resuscitation itself, and attention to patient comfort needs. We then interviewed the patient, consultant physician, house (...) officer, and primary nurse and compared the ward notes with the understandings of these staff members. SETTING: The medical service of an urban university medical centre. RESULTS: The average number of documented CCCs addressed per DNR order was 1.1. The ward notes generally agreed with the perceptions of patients, house officers, and nurses (% agreement with notes = 79%, 77%, and 82%; kappa = 0.43, 0.40, 0.50). Consultant physicians' understandings were poorly reflected in the ward notes (% agreement = 59%; kappa = 0.18). They overestimated attention to CCCs compared with the notes (P < 0.0001) and with other observers (P < 0.0001). CONCLUSION: Chart review for attention to CCCs accurately reflects the understandings of patients, house officers, and nurses, but consultant physicians report more attention to CCCs than is recorded in the ward notes or understood by other observers. Better communication regarding end-of-life care plans should be encouraged. (shrink)

SARS, like HIV, placed healthcare workers at risk and raised issues about the duty to treat. But philosophical accounts of the duty to treat that were developed in the context of HIV did not adequately address some of the ethical issues raised by SARS. Since the next epidemic may be more like SARS than HIV, it is important to illuminate these issues. In this paper, we sketch a general account of the duty to treat that arose in response to HIV. (...) Our purpose is not to defend or criticise this account, but to show that it needs to be developed in order to address three important issues. The first issue concerns how risks should be distributed among healthcare professionals. The second issue concerns the conflicts that arise between professional duties and family duties. The third issue concerns the forms of support that societies owe healthcare workers during epidemics. Our descriptions of these issues are drawn from our experience of the SARS epidemic in Taiwan. Development of the knowledge base for a profession depends on research and scholarship that builds on the insights and work of scholars within the discipline and is disseminated through the literature. The purpose of this study was to examine a unique collection of 79 articles selected by editors as representative of their nursing journals. Articles were assessed for congruence with long‐standing values and conceptual definitions of nursing, and the extent to which they built on prior literature published in nursing. Articles (...) were scored based on whether they reflected four characteristics of nursing as a discipline (holism, social context, goal of health, and consistency with common definitions of nursing); an abstract score on the extent to which the title, abstract, or keywords indicated a general focus on nursing; and a distinction score based on whether the article distinguished nurses or nursing from other providers. Fifty of the articles received an article score of 4, indicating all four disciplinary characteristics were present in the article's content. While the majority of the articles were congruent with fundamental nursing values and perspectives, only 28% of the sources cited were from nursing sources. The lack of citations to nursing literature, coupled with an assessment that reveals gaps in substantive content that builds on nursing knowledge, raises questions about the future of nursing perspectives in the literature. BackgroundReconciling results obtained using different types of sensory measures is a challenge for autism sensory research. The present study used questionnaire, psychophysical, and neurophysiological measures to characterize autistic sensory processing in different measurement modalities.MethodsParticipants were 46 autistic and 21 typically developing 11- to 14-year-olds. Participants and their caregivers completed questionnaires regarding sensory experiences and behaviors. Auditory and somatosensory event-related potentials were recorded as part of a multisensory ERP task. Auditory detection, tactile static detection, and tactile spatial resolution psychophysical thresholds were (...) measured.ResultsSensory questionnaires strongly differentiated between autistic and typically developing individuals, while little evidence of group differences was observed in psychophysical thresholds. Crucially, the different types of measures appeared to be largely independent of one another. However, we unexpectedly found autistic participants with larger auditory Tb ERP amplitudes had reduced hearing acuity, even though all participants had hearing acuity in the non-clinical range.LimitationsThe autistic and typically developing groups were not matched on cognitive ability, although this limitation does not affect our main analyses regarding convergence of measures within autism.ConclusionOverall, based on these results, measures in different sensory modalities appear to capture distinct aspects of sensory processing in autism, with relatively limited convergence between questionnaires and laboratory-based tasks. Generally, this might reflect the reality that laboratory tasks are often carried out in controlled environments without background stimuli to compete for attention, a context which may not closely resemble the busier and more complex environments in which autistic people’s atypical sensory experiences commonly occur. Sensory questionnaires and more naturalistic laboratory tasks may be better suited to explore autistic people’s real-world sensory challenges. Further research is needed to replicate and investigate the drivers of the unexpected association we observed between auditory Tb ERP amplitudes and hearing acuity, which could represent an important confound for ERP researchers to consider in their studies. Le retour au mythe, à travers une grille de lecture juridique, autorise une mise en perspective de la rationalité juridique contemporaine. Chaque mythe antique est en rapport avec la fondation du droit. Mais, le droit positif a (...) lui-même une dimension mythologique importante. En raison de sa fonction normative, il est pétri d'imaginaire et de fictions. Or, à une époque comme la nôtre, où les mythes et autres métarécits sont déconsidérés, assimilés à une pensée préscientifique, il faut peut-être reconnaître que ce sont ces métarécits qui donnent du sens et qui peuvent renforcer la légitimité du droit dans sa dimension instituante. The role of individual factors in behavioral neuroscience is an important, but still neglected, area of research. For example, the Elevated Plus-Maze Test has been one of the most used paradigms to gauge unconditioned aversively motivated behavior in rodents. However, despite a great number of experiments with this test there have been only few efforts to assess systematic individual variations in the elevated plus-maze and related neurobiological functions. The present review aims to give, first, a general overview and introduction about (...) the test, and second, an animal model of anxiety based on natural variance of plus-maze behavior within a given unselected population of rats. Finally, critical aspects of such approaches in animal research are discussed, and suggestions are given as to where to go from here. (shrink)

Les apories auxquelles les médiations symboliques contraignent l’agir doivent nourrir (...) la double nécessité d’un “devoir de vigilance” et d’une “timide espérance”: telle est à la fois la difficulté irréductible et la force critique de l’analyse ricœurienne de l’imagination socialisante. Cet article porte sur les aspects non communicationnels du métier des professionnels de la traduction. Les différents métiers de la traduction exigent des compétences linguistiques en réalité très diversifiées. Des données récentes, notamment d’Europe et d’Amérique du Nord, démontrent l’importance du « secteur des services linguistiques ». Si l’on dispose assez largement de statistiques fiables sur l’ampleur du marché de la traduction dans les pays développés, on n’en a pratiquement aucune pour les pays en voie de développement, même les plus (...) grands. Nous savons très peu de choses des conditions de travail des traducteurs, mais une récente étude européenne montre qu’en général les traducteurs littéraires sont mal payés et souvent soumis à de lourdes charges de travail, ce qui nuit à la qualité. D’autres études sont manifestement nécessaires. La Fédération internationale des traducteurs vise à promouvoir le professionnalisme des métiers de la traduction et l’amélioration des conditions de travail des traducteurs en rassemblant les diverses associations nationales. Néanmoins, les instances dirigeantes de cette fédération sont dominées par l’Europe et les États-Unis alors même que l’on assiste à l’émergence de nouvelles puissances sur la scène mondiale et que les besoins en traduction ne cessent d’augmenter : ce sont de tels déséquilibres que l’article entend également aborder.This article looks into the non-communicational aspects of the work of translating professionals. Translators work in a variety of jobs that require a range of language skills. Recent data, particularly from Europe and North America, demonstrate the economic importance of the “language services industry”. Reliable statistics on the size of the labour market are available principally from developed countries, but there is a lack of such data on even the largest developing countries. We know very little about the working conditions of translators; however, a recent European survey indicates that, in general, literary translators are poorly paid and frequently required to take on heavy work loads, with negative consequences for quality. More studies are clearly necessary. As a forum for national translators’ associations, the International Federation of Translators promotes professionalism in the translating field and proper working conditions for translators. However, the FIT’s governing bodies are dominated by Europe and North America, despite the rise of the new economic powers and the increase in demands for translation. Merleau-Ponty et Husserl dans son œuvre tardive tentent de réenchanter la nature, mais du point de vue de la perception. Leur insistance sur la structure et la forme perceptuelles est un moyen de protection contre le réductionnisme et donc, en un sens, réenchante le monde qui, pour parler comme Merleau-Ponty, est « con­damné au sens (...) ». Être « con­damné au sens », cela signifie être forcé de reconnaître à nos réalisations rationnelles les plus abouties, à nos actes visant à relier ce qui est séparé à partir d’une relationalité déjà perçue, une dépendance génétique (ou Fundierung ) par rapport à des événements de niveau inférieur, pré-rationnels, dans lesquels le soi est présent de façon latente. Être « con­damné au sens » signifie que les réalisations logiques et rationnelles pleinement articulées doivent, pour être dotées de sens, être ramenées à des structures proto-rationnelles dans le champ de la perception. Que Merleau-Ponty et Husserl révèlent la sphère pré-prédicative comme une sphère de simple signification, ce fait reflète une critique commune de l’empirisme. Le monde partiellement réenchanté est un monde conditionné par des horizons de signification qui sont de réels aspects du monde à décrire. Je fais valoir que la perception optimalement monstrative atteint les choses mêmes dans leur télos monstratif où elles se montrent le mieux. Je conclus avec quelques remarques sur la manière dont cette conception du réenchantement mobilise la philosophie de John McDowell, qui est, malgré lui, un partisan de la structure dans le champ perceptuel. Inspired by early-nineteenth-century discoveries about heat transfer, the French physicist Claude Pouillet measured the influx of solar radiation at the earth and, in 1838, asked what these observations revealed about the temperature of the sun and of space itself. At about the same time, the British natural philosophers John Herschel and J. D. Forbes made similar measurements in order to better understand the sun's influence on climate. Those who have read me, in particular those who have read “Paul de Man’s War,” know very well that I would have quite easily accepted a genuine critique, the expression of an argued disagreement with my reading of de Man, with my evaluation of these articles from 1940-42, and so on. After all, what I wrote on this subject was complicated enough, divided, tormented, most often hazarded as hypothesis, open enough to discussion, itself discussing itself enough in advance for me (...) to be able to welcome questions, suggestions, and objections. Provided this was done so as to demonstrate and not to intimidate or inflict wounds, to help the analysis progress and not to score points, to read and to reason and not to pronounce massive, magical, and immediately executor verdicts. Five of the six “responses” that I reread last night are written, as one used to say, with a pen dipped in venom. Less against the de Man of 1940-42, perhaps, then against me . Less against me, in truth, than against “Deconstruction” . How can the reader tell that these five “critical responses” are not “responses,” critical texts or discussions, but rather the documents of a blinded compulsion? First of all, the fact that they are all monolithic. They take into account none of the complications of which my text, this is the very least one can say, is not at all sparing. They never seek to measure the possibility, the degree, or the form, as always happens in an honest discussion, of a partial agreement on this or that point. The thesis we develop in this essay is that all humans are endowed with a moral faculty. The moral faculty enables us to produce moral judgments on the basis of the causes and consequences of actions. As an empirical research program, we follow the framework of modern linguistics.1 The spirit of the argument dates back at least to the economist Adam Smith (1759/1976) who argued for something akin to a moral grammar, and more recently, to the political philosopher John Rawls (...) (1971). The logic of the argument, however, comes from Noam Chomsky’s thinking on language specifically and the nature of knowledge more generally (Chomsky, 1986, 1988, 2000; Saporta, 1978). If the nature of moral knowledge is comparable in some way to the nature of linguistic knowledge, as defended recently by Harman (1977), Dwyer (1999, 2004), and Mikhail (2000; in press), then what should we expect to find when we look at the anatomy of our moral faculty? Is there a grammar, and if so, how can the moral grammarian uncover its structure? Are we aware of our moral grammar, its method of operation, and its moment-to-moment functioning in our judgments? Is there a universal moral grammar that allows each child to build a particular moral grammar? Once acquired, are different moral grammars mutually incomprehensible in the same way that a native Chinese speaker finds a native Italian speaker incomprehensible? How does the child acquire a particular moral grammar, especially if her experiences are impoverished relative to the moral judgments she makes? Are there certain forms of brain damage that disrupt moral competence but leave other forms of reasoning intact? And how did this machinery evolve, and for what particular adaptive function? We will have more to say about many of these questions later on, and Hauser (2006) develops others. These tended to be more hands-on people and thus, in my understanding at least, had a more particular relationship with things in their world than others for whom objects were examples of types of things.This brief vignette serves as an introduction to my qualified enthusiasm for the project taken up by Allison Mitchell in her paper, "Taking Mentality Seriously: A Philosophical Inquiry into the Language of Addiction and Recovery" (Mitchell, 2006). Indeed, as a practicing psychiatrist I would be hard pressed not to endorse the use of language as a key to deeper aspects of experience.My following remarks are mostly contra Mitchell's hypothesis, but before beginning I name one more reason I think this project is worthwhile. In spite of much research and recitations of the motto "treatment works," we do not presently have a reliable treatment for addiction. The linguistic portrait painted by Mitchell allows us to view our treatments in vivo and reflect upon what we see. (For the purpose of this commentary, I consider alcoholism and Alcoholics Anonymous [AA] as a general example of addiction and treatment.)Medication treatment remains almost inconsequential except when applied for comorbid psychiatric disorders rather than the primary addiction. Even then it rarely serves to undo some form of self-medication, but instead only offers an important leg up in battling the addiction.Research and much experience has shown AA to be the single best treatment for alcoholism (Vaillant and Hiller-Sturmhofel 1996). Some investigators have proposed underlying mechanisms for its efficacy (some, like "creating dependency" run very counter to Mitchell) (Vaillant 2005). AA's success is highly dependent upon attendance (McCrady et al. 2004), which can of course be a marker for getting better in the first place and not solely a cause of improvement (i.e., people who are doing better attend more meetings not vice- versa). Even within AA, the dropout rate is quite high (Martin et al. 1996). Workers in this area [End Page 223] have raised questions about AA's approach and have proposed other avenues to sobriety, including interpersonal, cognitive–behavioral, and relapse prevention programs (Witkiewitz and Marlatt 2005, 2004; O'Dwyer 2006). Lamentably, some very large studies failed to show any effective ability to match up alcoholics with a particular treatment modality (Church 2004; Read 2004).Given the lack of clarity with which we still work, I think an approach like Mitchell's is a welcome call for serious reflection. The limitations of a linguistic analysis place an unfortunate constriction on implications to be drawn.Mitchell's chief concern is that the language of recovery, as reflected in twelve-step programs, betrays and even fosters a degree of passivity, which leaves the addict without an adequate sense of agency and autonomy with which to combat addiction. From a more philosophical perspective, Mitchell believes this is due to an incomplete philosophical materialism; one that lacks "mentality" (i.e., the sense that part of our physical being is made up of mental activities such as emotions, motivations, beliefs, etc.). This attitude is manifest in a "pretheoretic conception of the self" that leaves the addict with a dearth of self-awareness as a mental agent of action and change.In place of the standard recovery model in use today, Mitchell suggests cultivating a sense of self that values and fosters engaged agency that is both capable of self-control and responsive to external obligations.A Few ConcernsFirst, I will offer a few concerns about premises at work within the paper. We perceive smells as perduring complex entities within a distal array that might be conceived of as smellscapes. However, the philosophical orthodoxy of Odor Theories has been to deny that smells are perceived as having a distal location. Recent challenges have been mounted to Odor Theories’ veracity in handling the timescale of olfactory perception, how it individuates odors as a distal entities, and their claim that olfactory perception is not spatial. The paper does not aim to dispute these criticisms. Rather, (...) what will be shown is that Molecular Structure Theory, a refinement of Odor Theory, can be further developed to handle these challenges. The theory is further refined by focusing on distal perception that requires considering the perceptual object as mereologically complex persisting odor against a background scene conceived of as a smellscape. What will be offered is an expansion of Molecular Structure Theory to account for distal smell perception within natural environments. (shrink)

When it originated in the late 19th century, psychometrics was a field with both a scientific and a social mission: psychometrics provided new methods for research into individual differences, and at the same time, these psychometric instruments were considered a means to create a new social order. In contrast, contemporary psychometrics - due to its highly technical nature and its limited involvement in substantive psychological research - has created the impression of being a value-free discipline. In this article, we develop (...) a contrasting characterization of contemporary psychometrics as a value-laden discipline. We expose four such values: that individual differences are quantitative (rather than qualitative), that measurement should be objective in a specific sense, that test items should be fair, and that utility of a model is more important than its truth. Our goal is not to criticize psychometrics for employing these values, but rather to bring them into the open and to show that these values are not inevitable and are in need of systematic evaluation. We are immersed within an odorous sea of chemical currents that we parse into individual odors with complex structures. Odors have been posited as determined by the structural relation between the molecules that compose the chemical compounds and their interactions with the receptor site. But, naturally occurring smells are parsed from gaseous odor plumes. To give a comprehensive account of the nature of odors the chemosciences must account for these large distributed entities as well. We offer a focused review of (...) what is known about the perception of odor plumes for olfactory navigation and tracking, which we then connect to what is known about the role odorants play as properties of the plume in determining odor identity with respect to odor quality. We end by motivating our central claim that more research needs to be conducted on the role that odorants play within the odor plume in determining odor identity. (shrink)

Michel Foucault’s suggestion that this century would become known as “Deleuzian” was considered by Gilles Deleuze himself to be a joke “meant to make people who like us laugh, and make everyone else livid.” Whether serious or not, Foucault’s prediction has had enough of an impact to raise concern about the potential “deification” of this enormously influential French philosopher. This paper is a review of the influence that lógos has had on ancient Greek, Jewish, and Christian writings. During the philosophical era known as Middle Platonism, the concept/ontology of the lógos played a unique role in enabling Pagan, Jewish, and Christian intellectuals to communicate on a small space of common ground.

In Nicomachean Ethics X.7–8, Aristotle defends a striking view about the good for human beings. According to Aristotle, the single happiest way of life is organized around philosophical contemplation. According to the narrowness worry, however, Aristotle's contemplative ideal is unduly Procrustean, restrictive, inflexible, and oblivious of human diversity. In this paper, I argue that Aristotle has resources for responding to the narrowness worry, and that his contemplative ideal can take due account of human diversity.

The field of AI safety aims to prevent increasingly capable artificially intelligent systems from causing humans harm. Research on moral alignment is widely thought to offer a promising safety strategy: if we can equip AI systems with appropriate ethical rules, according to this line of thought, they'll be unlikely to disempower, destroy or otherwise seriously harm us. Deontological morality looks like a particularly attractive candidate for an alignment target, given its popularity, relative technical tractability and commitment to harm-avoidance principles. I (...) argue that the connection between moral alignment and safe behavior is more tenuous than many have hoped. In general, AI systems can possess either of these properties in the absence of the other, and we should favor safety when the two conflict. In particular, advanced AI systems governed by standard versions of deontology need not be especially safe. (shrink)

In lieu of an abstract, here is a brief excerpt of the content: Seven Poems NICOLAS CALAS (Translated by Avi Sharon) hellenizing surrealism: a greek door to europe Nicolas calas (Kalamares) may be considered merely a minor Greek poet, but he had a major global persona and influence. In the middle of the last century he played a catalyzing role in the international avant garde: He was a Zelig-like polemicist in three languages (Greek, French, and English) and across three cultural (...) capitals (Athens, Paris, and New York). But he always fought on a singular front: surrealism. Born in Lausanne in 1907, he grew up in Athens and by the later 1920s began to stand out in literary circles (he was over 6' 4") for his modernist if not revolutionary views. Starting from an interest in Freud and Marx, the subconscious and the revolutionary, Calas soon arrived at their natural synthesis—surrealism. Around the time when a distinctly Greek form of surrealist poetry emerged, with the 1935 publication of “Blast Furnace” by Andreas Embiricos, Calas was on his way to becoming its unofficial spokesman. He moved to the epicenter of the movement in Paris and with the 1938 publication of Foyers d’Incendie became the “most lucid and audacious” of founder André Breton’s acolytes, both prophet and demagogue of the group. Carried along in the current of European artists and thinkers leaving Europe for New York, he would continue the fight on the western wing of the faction (literally, coming to blows at a cocktail party with Clement Greenberg, representing the opposing Abstract Expressionist side). In 1942 he published another clarion pamphlet, Confound the Wise, giving the movement voice in English and befriending its most visible local supporters and practitioners, from Peggy Guggenheim to Marcel Duchamp. arion 27.1 spring/summer 2019 The Wyndham Lewis of the operation, Calas was a cross-border catalyst, evangelizing the role of surrealism as a liberating and generative force in modern literature and art. For him and other writers and poets, the weapon that would most effectively derange the reader’s habitual conformism into revelatory and revolutionary perception was the surrealist image, poetry’s lingua franca. For Greek practitioners it was completely natural for that magical representation to arise out of their god-infested, sun-filled landscape. Here they had a force that was both blinding and enlightening, penetrating and transformative, local and universal. For Calas, the primary echo or reflection of that essential image was the island of Santorini, referenced in several of the translations here (and reminiscent of his fellow national Nikos Gatsos’s use of the island of Amorgos in a similar context). It stood as the very symbol of fiery transformation, an image monstrous enough to shock the reader into a super-rational embrace of its own form of logic. This Hellenization of surrealism, like the Hellenization of modernism itself, was to become an important, transformative power in its own right. For many, the origin (and likewise, for many, the enclosing border ) of surrealism was France. “But it is French. It is their invention,” was how William Carlos Williams saw it, to his chagrin. Williams was convinced that the objective concentration on the image itself (“no ideas but in things”) could offer a salutary corrective to American poetry of his time. “It is the surrealists who have invented the living defense of literature,” he wrote in a 1929 essay. But for a poet so at one with the American Grain to be reconciled with surrealism’s ‘Francite’ he needed some way to cross the divide. His admiration for Calas’s work in clarifying and promoting the group’s ideas enabled the Greek poet to serve as a mediator, to allow the creative transference of its rebellious wisdom into Williams’s poetry. To borrow the title of one of his early American essays, Calas provided Williams a “Greek door to Europe.” In translating four of Calas’s French poems into English, published in 1941 with a frontispiece by the surrealist painter and magician Kurt Seligman, Williams leveraged Calas as the vehicle through which the “enabling foreignness” of surrealism could be grafted into the grain of his American modernist work, just as he set out on his magnum opus, Paterson.
